What is an EMPLOYER OF RECORD (EOR) in Italy and how it works

The term Employer of Record (EOR) refers to a service wherein a provider hires an employee for a third party, relieving the client of the legal and financial responsibilities associated with establishing a local entity. In Italy, only providers authorized by the Italian Ministry of Labour can offer this service, ensuring complete compliance.

    Peoitaly becomes the legal employer of the workers, even though the employees work at the direction of another company (the employee is therefore leased to the client). This means Peoitaly is responsible for adhering to Italian labour laws, managing employment contracts, and ensuring compliance with local regulations.

    Peoitaly is responsible for payroll processing, including calculating and disbursing salaries, deducting taxes, and managing social security contributions. Additionally, Peoitaly will handle employee benefits and entitlements in accordance with the relevant CBA (Collective Bargaining Agreement) and, where possible, with the client’s instructions.

    Peoitaly takes care of tax withholding and filing on behalf of the employees. This includes income tax, social security contributions, and any other applicable taxes.

    Peoitaly ensures that all employment arrangements comply with Italian labour laws, regulations, and employment standards. This includes issues related to working hours, leave entitlements, termination procedures, and more.

  • Contractual Relationships

    The client company (the one utilizing Peoitaly service) maintains the day-to-day oversight and management of the employees, while Peoitaly handles the legal and administrative aspects of employment.
